Service offering and liability - Terms and Conditions (T&C)
The Alqarn Freelancing (TAF) is a web-based business entity and is developed for the purpose of facilitating the introduction of registered Subject Experts Matters (SMEs), Talented Professionals and Consultants (Service Providers - SPs) to Clients by using its infrastructure and processes.
All registered SPs are allowed to suspend or cancel their registration at any time and without prior notice.
It is expected that all information provided by the SPs is correct and accurate and shall be updated regularly to reflect the service they offer. Any inclusion of illegal or copyright protected information is totally unacceptable.
Registration of clients wishing to procure TAF services is only needed once a suitable SP is selected and an introduction with the SP is demanded. The research for the suitable SP can be made upfront.
Selection and booking of the SP can be done directly from the SP Registration page on the Website.
All Service Providers will be charged a one-time registration fee equivalent to the hourly rate stated in the Service Provider Registration Form.
The registration fee is paid by the SP once an introduction opportunity is identified.
TAF has the right to suspend or restrict its services temporarily or permanently at any time and without giving any notice or reason.
TAF will make every effort to protect personal data and treat them as confidential.
TAF can adapt, change or reject any contents provided by the SPs or displayed on hyperlinked information.
It is prohibited to sell or process the information commercially by all users. TAF has the right to claim compensation to the amount of the lost revenues, opportunity costs and the legal costs incurred in protecting its rights in case of a breach.
From time to time, TAF will review and update these T&C. All users are advised to keep themselves up to date regarding possible changes to the T&C.
Any disputes, disagreement or differences between TAF and the users shall be settled in good faith through negotiation. TAF and it's users shall make their best effort to avoid initiating legal proceedings.
Once an introduction is arranged between the client and the SP, a fee of (double published the hourly rate) shall be paid to TAF. The introduction charges fee is shared 50% between SP and client.
In case the requested client's introduction is not made in a good faith and is determined to be non-genuine, the introduction fee may not apply. This will be looked at case by case and in such circumstances the SP/client must notify TAF in writing within 3 working days of the introduction or the full fee will be due.
A non-genuine request of introduction is defined as:
The SP failed to respond to client after several contacts attempts.
When a client request for an introduction but in reality there is no real need or intent for appointment of a service provider.
There is a significant difference between the client’s requirements and the skills & capabilities published in the SP's profile.
The client must notify the SP immediately once an assignment of introduction is accepted. In the interest of all parties, the contact must be made even if the assignment obviously does not fit to the SP’s skills or if the SP is currently unavailable. TAF shall be informed within three (3) working days if the SP could not be reached.
All invoices generated by TAF (registration & booking) will contain the service fee that must be paid within 3 working days of registration/booking.
All bills to SP/client will be delivered by email. Other methods of bill delivery will be evaluated and can be agreed case by case.
The following points are valid until a related contract/agreement is signed by the client and the SP for provision of services:
The first meeting between the client and the SP shall be treated as an introduction to verify project suitability and to determine the SP’s capabilities. This meeting shall not exceed one hour and is free of charge.
Once the the client agrees to use the services of a the SP, a contract/agreement between the two parties shall be generated immediately and signed by both parties. TAF will only do the introduction facilitation and will not intervene in the contract/agreement formalities between the two parties.
All the payments made by the client to the SP must be in accordance with the listed hourly rate.
The SP must guarantee to charge the client only the published hourly rate.
All other terms will be according to the contract/agreement entered into between the client and the SP whether in writing or verbally instigated.
These T&C shall be accepted immediately when users first access and start using the service, information and or processes of TAF. Any changes or adaptations to these T&C must be in writing.
In the case of any of the T&C is not effective or unworkable then all other terms shall remain valid. The ineffectual or unworkable term will be reviewed and if necessary will be removed or changed/replaced by another term.
